Shop rules

I. General provisions

  1. These Terms and Conditions (hereinafter: "Terms") set out the rules for using the online store available at https://castle-gothic.com/ (hereinafter: "Store"), the rules for registering and using a User Account, placing orders in the Store and concluding Sales Contracts.
  2. The owner and operator of the Store is:

  3. The User's IT system must meet the minimum technical requirements for using the Store. In particular, the User must have a device with internet access and an installed web browser that supports cookies.
  4. The Seller can be contacted electronically at sklep@castle-gothic.pl, by post at the registered office address or via the contact form available on the Store's website.
  5. These Terms apply to:
    a) Consumers - natural persons who enter into a legal transaction with the Seller that is not directly related to their business or professional activity,
    b) Business Customers - natural persons, legal persons and organisational units conducting business activity and making purchases in the Store in the course of that activity.

II. Definitions

  1. User - any person visiting the Store, including a Consumer or a Business Customer, who uses services provided electronically by the Seller.
  2. Consumer - a natural person purchasing goods or services in the Store for purposes not directly related to their business or professional activity.
  3. Business Customer - a natural person, legal person or organisational unit conducting business activity and making a purchase in the Store in the course of that activity.
  4. Goods - a movable item available in the Store that is the subject of a Sales Contract.
  5. Sales Contract - a contract for the sale of Goods concluded between the User and the Seller via the Store, on the terms set out in these Terms.
  6. Order - the User's declaration of intent submitted via the form available in the Store, aimed directly at concluding a Sales Contract.

III. Terms of use of the Store

  1. The User is obliged to use the Store in accordance with the law and accepted standards of conduct, respecting the personality rights and intellectual property rights of third parties.
  2. The User is obliged to provide true and accurate data.
  3. Through the Store, the User may order the Goods presented in the Store.

IV. Registration and User Account

  1. The User may create a free User Account in the Store.
  2. Registration takes place by completing and confirming the registration form available in the Store.
  3. A User Account is not required to place an Order, but it gives access to additional features (order history, quick orders, discounts, etc.).
  4. The User may close the User Account at any time by sending a request to the Seller.

V. Placing Orders and conclusion of the Sales Contract

  1. The Store accepts Orders 24 hours a day, 7 days a week.
  2. To place an Order, the User adds the selected Goods to the "cart" and continues the ordering procedure, choosing, among other things, the delivery method and payment method and providing the data necessary to fulfil the order.
  3. Placing an Order constitutes an offer to conclude a Sales Contract, submitted to the Seller by the User.
  4. After receiving the Order, the Seller confirms its acceptance by e-mail. The Sales Contract is concluded at the moment the Order is confirmed.

VI. Prices and payment methods

  1. Prices of Goods are shown in the currency indicated in the Store for the country of delivery and include VAT.
  2. The price shown for the Goods at the time the Order is placed is binding.
  3. The available payment methods are displayed when placing the Order and depend on the country of delivery. They include, among others, payment cards, Apple Pay, Google Pay, Klarna and local payment methods available in the given country.
  4. The Seller reserves the right to introduce and withdraw individual payment methods.

VII. Delivery and shipping costs

  1. Delivery of Goods is free of charge and available to the countries served by the Store.
  2. The Order is prepared for shipment within 1-5 business days, and delivery usually takes 2-10 business days. The total estimated delivery time is 3 to 15 business days from placing the Order.
  3. Parcels are shipped from logistics centres in the European Union or from international logistics centres. Details are set out in the Shipping Policy available in the Store.

VIII. Right of withdrawal (Consumer)

  1. A Consumer who has concluded a distance Sales Contract has the right to withdraw from it without giving any reason within 14 days of receiving the Goods.
  2. To exercise the right of withdrawal, the Consumer should send the Seller an unequivocal statement of withdrawal from the contract, in writing or electronically, for example by e-mail to sklep@castle-gothic.pl.
  3. The Consumer bears the direct cost of returning the Goods.
  4. In the event of an effective withdrawal from the contract, the Seller refunds to the Consumer all payments received, including delivery costs (except for additional costs resulting from a delivery method chosen by the Consumer other than the cheapest standard delivery method offered by the Seller), without undue delay and no later than 14 days from receiving the statement of withdrawal. The refund is made automatically using the same payment method the Consumer used for the Order. The Seller may withhold the refund until it has received the Goods or proof of their return.

IX. Complaints and statutory warranty

  1. The Seller is obliged to deliver Goods free from defects.
  2. If a defect in the Goods is found, the User has the right to file a complaint, in particular under the statutory warranty.
  3. Complaints should be submitted to the Seller in writing or electronically, describing the defect and the remedy requested by the User (e.g. replacement, repair, price reduction or termination of the contract).
  4. The Seller will process the complaint within 14 days of receiving it.

X. Personal data and Privacy Policy

  1. Users' personal data are processed by the Seller in accordance with applicable law and the Privacy Policy available in the Store.
  2. Providing personal data is voluntary but necessary to fulfil the Order or to use selected features of the Store.

XI. Final provisions

  1. These Terms come into force on the date of their publication on the Store's website.
  2. The Seller reserves the right to amend these Terms for important legal, organisational or technical reasons. Changes will be published on the Store's website together with information on the date they come into force.
  3. Sales Contracts concluded before an amendment of the Terms are governed by the version in force at the time the User placed the Order.
  4. In matters not regulated by these Terms, the generally applicable provisions of Polish law apply, including the Civil Code and the Consumer Rights Act. The choice of Polish law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
  5. Disputes arising in connection with the conclusion and performance of Sales Contracts will be resolved by the competent ordinary courts. The Consumer may use the out-of-court complaint-handling and dispute resolution procedures available in their country of residence, including assistance from the competent consumer protection authorities.
